FAQ: Frequently Asked Questions about Licensing
All Rights Reserved, except for specific rights granted under each license:
Unlicensed:
- You may build Screensaver Installers for testing only. No distribution, non-commercial or for-profit use allowed. Built installers will expire after three days and will retain iScreensaver.com watermarking.
- If you purchased any license using the non-commercial discount, then no commercial or for-profit use is allowed. All other terms are the same as your specific license below:
- This is a one-time purchase.
- Build, Distribute, and Install screensavers on up to 5 different computers.
- The editor software (Designer) may be installed and registered on a single (one) computer.
- Personal use only: No Commercial or For-Profit use permitted.
- Screensavers will include your author name.
- This is an annual license.
- Build, Distribute, and install screensaver on up to 100 different computers per year.
- The editor software (Designer) may be installed and registered on up to 2 computers for one person.
- Commercial and for-profit use is permitted.
- Screensavers will be built with your Business or Organization name.
- This is an annual license.
- Build, Distribute, and install screensaver on up to 1000 different computers per year.
- The editor software (Designer) may be installed and registered on up to 4 computers for 2 people.
- Commercial and for-profit use is permitted.
- You may change the author name and build screensavers for third party clients.
- This is an annual license.
- Build, Distribute, and install screensaver on an unlimited number of different computers.
- The editor software (Designer) may be installed and registered on up to 10 computers for 5 people
- Commercial and for-profit use is permitted.
- You may change the author name and build screensavers for third party clients.
- Priority direct email support (during the license term)
- You may use Managed Installation tools to distribute on your in-house computers.
Use or purchase of this software is according to the following terms:
- You are obtaining a limited, restricted license to use the software.
- You are not purchasing or owning the software.
- All intellectual property rights of the iScreensaver Software, and all commercial rights, including copyright, patent, trademark, distribution, sub-licensing, resale and other rights, in perpetuity and throughout the universe, remain those of Xochi Media Inc, except for those exceptions expressly specified below.
- The software is provided AS-IS and no warranty or guarantee is provided as to its fitness for use.
- Liability for any consequential damages shall be strictly limited to the purchase price.
- These terms may be changed and/or modified by Xochi Media Inc. at any time upon prior written notice to you via email to the email addresses associated with your license order. In such event, you will have the option to reject the changed terms, terminate the license and get a pro-rated refund for the balance of the remaining license term.
- Violation of any term of this license can be cause for a revocation of the license.
iScreensaver software is a tool that allows the user to bundle third party material (audio, video, images, text, SWF flash files and others) into a software distribution device ("Installer"). Because of the potential for violation of the Digital Millennium Copyright Act http://www.loc.gov/copyright/legislation/hr2281.pdf ("DMCA") and pre-existing National and International Copyright Law, you hereby agree:
- You accept full liability for any complaints and/or actions arising from your use of iScreensaver software.
- Specifically, by using iScreensaver software you agree for purposes of DMCA-related liability, that Xochi Media Inc., is totally immune from liability according to Subsection (C) of Sec 202, 'INFORMATION RESIDING ON SYSTEMS OR NETWORKS AT DIRECTION OF USERS', and that furthermore for any derivative works creating using iScreensaver, you agree to function as the "Designated Agent" (as per Sec 202, pp. 512) for any derivative uses that you have authored, and will agree to maintain a website, link to it from your Installer, and provide sufficient notification on your website for complaint resolution as provided by the DMCA.
- You have, and will, in all uses of iScreensaver, follow all applicable laws, including copyright law and content restrictions, and perform due diligence to ensure you are not in violation of any applicable law.
